“KORRUPSIYA VE JAMIYYAT” JOURNAL’S APPEAL NOT FULFILLED Print E-mail

Today, 16 September, in the Baku Appellate  Court, under the chairmanship of Judge Hilal Khalilov, a hearing took place on the appeal of “Korrupsiya ve  Jamiyyat” Journal’s  Editor-in-chief Mammad Ahmedoglu against the verdict of the Binagadi District Court adopted on his lawsuit against the Press Council and the Council’s Deputy Chairman Vugar Rahimzade.
Plaintiff Mammad Ahmadoglu, and Mushfig Alasgerli, Rahim Huseynzade  on behalf of the defendant, and Vugar Rahimzade’s representative Elchin Namazov participated in the hearing. Mammad Ahmadoglu filed a motion to submit the results of the Press Council’s investigation regarding “Korrupsiya ve Jamiyyat” journal to the court. But the judge did not fulfill the motion.
Then M.Ahmadoglu spoke and said that the publication of the journal was stopped after the Press Council announced the “Korrupsiya and Jamiyyat” journal a racketeering press.  “All publishing houses refused to publish our journal on the basis of the Press Council’s appeal,” said Ahmadoglu. “That is why I demand that the decision of the Binagadi District Court should be rescinded, the Press Council should publish a refutation and every defendant should  pay 4000 AZN in compensation for financial damages and  1000 000 AZN for moral damages.”      
The Press Council representative Mushfig Alasgarli did agree to the lawsuit and said that there was enough evidence to declare “Korrupsiya ve  Jamiyyat” a racketeering journal.
The judge issued a decision not to fulfill the lawsuit
M.Ahmedoglu filed a lawsuit against the Press Council demanding that the council issue a refutation and apologize for including “Korrupsiya ve Jamiyyat” journal on the list of racketeering press, and the defendant pay 4000 (four thousand) AZN for material damages and 100 000(one hundred thousand) for moral damages. On 30 June 2009 the Binagadi District Court issued a decision not to fulfill the lawsuit.
