LAWYER FILES MOTION TO THROW OUT LAWSUIT AGAINST JOURNALIST

Today, 8 February, in the Nizami District Court, under the chairmanship of Judge Ziya Aliyev, a preliminary hearing was held on the special format lawsuit of Academic Jalal Aliyev against Yeni Musavat newspaper’s first deputy editor-in-chief Azer Aykhan and newspaper’s reporter Goshgar Bakili.
Plaintiff’s representative Mezahir Sadigov, defendant Azer Aykhan and his representative Elchin Sadigov participated in the hearing.
E.Sadigov filed a motion to adopt a decision to throw out the case since the lawsuit was not prepared in accordance with the demands of the legislation and the plaintiff did not come to the hearing.
M. Sadigov said that the motion is unfounded and asked not to fulfill it.
The Judge said that the decision regarding the motion will be issued on 10 February at 3:00 p.m.
J.Aliyev filed a lawsuit in the special format under articles 147 (defamation) and 148 (insult) of the Criminal Code claiming that the information in the article “The owner of the hotel about which the President was not happy identified; ‘Baku’ hotel’s owner is J.Aliyev” are degrading to his honor and dignity and does not conform to reality.
MP Jalal Aliyev is the brother of late President Heydar Aliyev and the uncle of the incumbent President Ilham Aliyev.
Yeni Musavat newspaper has been published since 1993 and operates as daily newspaper and has large circulation.

The investigation of the criminal case opened against imprisoned Editor-in-chief of Gundelik Azerbaijan and Realniy Azerbaijan newspapers Eynulla Fatullayev under article 234.1 of the Criminal Code concluded.
P.S. Nota Newspaper Editor-in-chief Sardar Alibeyli told the Institute for Reporters’ Freedom and Safety that his complaint given to Khatai District Police Department #35 due to his subjection to provocation on 20 February has not been investigated.
