CHANGES CONSIDERED TO FOUR LAWS TO RESTRICT MASS MEDIA ACTIVITIES

Azerbaijan’s government is considering making changes and amendments to four laws to restrict the operation of Mass Media.
The Institute for Reporters’ Freedom and Safety (IRFS) was told by MP Penah Huseyn that the Presidential Administration put forth a proposal to the Milli Mejlis (Parliament) to make additions and changes to laws “On Mass Media,” “On Freedom of Information,” “On operation-investigation activities,” “On intelligence and anti-intelligence activity,” and “On Obtaining information.”
According to Huseyn, these additions and changes were discussed in a meeting at the Parliament State Building, of the Law Policy and Human Rights permanent committees. This issue has been included in the agenda of Milli Mejlis meeting to be held on 12 February.
According to the proposed addition to the 60th article of Law “On Mass Media,” “Except operation-investigation cases, following someone, and subjecting them to video, photo or voice recording by media representatives without them knowing it or with them objecting to it is punishable as defined by law.” This addition is also being considered to be added to article 6 of the law “On Obtaining information,” article 21 of the law “On operation-investigation activities,” and to the law “On intelligence and anti-intelligence activity,” said P.Huseyn and noted that these antidemocratic changes are contrary to the Constitution of Azerbaijan and the European Convention. “The government will try to substantiate this addition with the amendment made to the constitution last year,” added P.Huseyn. “But this issue is a subject of the European Fundamental Human Rights and Freedoms.”
On 18 March 2009, in the referendum, amendment was made to article 32 (right to inviolability) of the Constitution, “Except in cases defined by law, nobody cannot be followed, and cannot be subjected to video or photo recording or this kind of actions without him knowing it or with him objecting to it.”
On 18 July, the National TV and Radio Council (NTRC) declared Azerbaijan TV and Radio Programming, the “state broadcaster” that is often referred to simply as AZTV, the winner in a tender for a sports channel.
The Institute for Reporters' Freedom and Safety denounces recent statements made by Presidential Administration head Ramiz Mehdiyev that are intended to mislead the local and international public about the press freedom situation in Azerbaijan and to deflect blame by making entirely false claims about other nations, and also condemns the high-level government cover-up, including actions tantamount to censorship, that followed one of Mehdiyev's comments.
On 12 March, at noon, in the press center of the Institute for Reporters` Freedom and Safety, the Youth Club Public Union will conduct a press conference regarding the departure of the US International Republican Institute from Azerbaijan at the end of this month. The representatives of the US Embassy and youth organizations will participate in the press conference.
International organizations disseminated statements condemning the decision of the Baku Appellate Court to not fulfill the appeal of imprisoned youth bloggers Adnan Hajizade and Emin Milli.
Yesterday, 10 March, in the Nasimi District Court, under the chairmanship of Judge Ikram Shirinov, a preliminary hearing was held on the lawsuit of Poligon information agency’s editor, former fourth year student of the State Oil Academy Elmin Badalov against the Rector of the Academy, Siyavush Garayev.
The investigation of the criminal case opened against imprisoned Editor-in-chief of Gundelik Azerbaijan and Realniy Azerbaijan newspapers Eynulla Fatullayev under article 234.1 of the Criminal Code concluded.
P.S. Nota Newspaper Editor-in-chief Sardar Alibeyli told the Institute for Reporters’ Freedom and Safety that his complaint given to Khatai District Police Department #35 due to his subjection to provocation on 20 February has not been investigated.
